How to Check an Assisted Living Facility’s License and Inspection Record

Families researching nursing homes at least have the federal star ratings to start from. Assisted living works differently: these communities are licensed and inspected by state agencies, not by Medicare — there is no national five-star system, no single federal database, and the depth of public information varies meaningfully from state to state. The good news is that a state license record, read properly, says more than most families realize.

What a license record shows

• License status — whether the community currently holds a full, active license, or something less than that.
• Licensed capacity — how many residents the state permits it to serve.
• Inspection history — when the state last surveyed the building and what it found.
• Violations and complaints — findings that the community did not meet licensing standards, and complaint investigations the state logged.

The license itself can carry a signal

In many states, the kind of license is itself an indicator of compliance history. Alongside full regular licenses, state licensing laws commonly provide for a provisional license — issued for a limited period to a facility that is temporarily unable to comply with standards — or a conditional or probationary status while an operator demonstrates compliance. The exact names and rules vary by state, but the pattern is the same: anything short of a full, regular license means the state is watching more closely. A facility operating on one of these is not automatically a bad choice, but it is a fact worth knowing and asking about directly: “What led to this license status, and what has changed?”

How to read violations fairly

A violation count alone can mislead in both directions. What matters is the substance: what the finding was, whether residents were affected, and whether it was corrected. A complaint on record means someone raised a concern serious enough for the state to log — not necessarily that it was substantiated. The inspection report itself, available through your state's licensing portal, shows how each finding was resolved. State inspectors do this work carefully; the challenge for families is simply that the reports are written for regulators, not for readers in the middle of a family decision.

Questions the record should prompt

• What did your most recent state inspection find, and what changed since?
• Has the community operated under a provisional or conditional license? When, and why?
• What is your current staffing on nights and weekends?
• What would cause a resident to be asked to move out — and how much notice is given?
